Stateside Brands LLC, and its brands and affiliates (collectively “Stateside Brands,” “we,” “us,” or “our”), created this Privacy Policy to inform our consumers, website users, promotion, contest, sweepstakes or campaign participants, online community participants, those who correspond with us via telephone, SMS (text message), email or QR Code, those who visit our tasting rooms and other physical locations, and those who purchase or inquire about our products and services (collectively referred to as “you” or “your”) about our practices regarding collection, use and disclosure of Personal Information (as defined below). Unless otherwise expressly stated, this Notice applies to each of our websites and mobile applications that link to this Notice (collectively referred to as “Sites”), and to information we collect offline.
Our Sites are intended only for users in the United States. By using the Sites, you agree and acknowledge that the Sites are hosted in the United States and that data collected through the Sites will be stored and processed in the United States. Please be advised that your use of the Platform is governed by U.S. law, this Privacy Policy, and the Terms and Conditions.
INFORMATION COLLECTED
When you contact us to help you with a question or concern, any personal information you provide is voluntary. We collect and use only the minimum information necessary to respond to your questions and concerns. We may also collect your personal information under other circumstances. In most cases, we collect limited personal information, such as name, address, telephone number, birth date, and/or email address. In limited cases, such as resume submissions, we may collect other personal information such as resume-related information.
Purchases on the Sites are done via credit card transactions. The transactions are handled by a third-party credit card payment processing company. Stateside Brands does not collect, access, store or process any credit card information.
Stateside Brands follows a standard procedure of using log files. These files log visitors when they visit websites. All hosting companies do this as a part of hosting services’ analytics. The information collected by log files include internet protocol (IP) addresses, browser type, Internet Service Provider (ISP), date and time stamp, referring/exit pages, and possibly the number of clicks. These are not linked to any information that is personally identifiable. The purpose of the information is for analyzing trends, administering the site, tracking users’ movement on the website, and gathering demographic information.
Stateside Brands uses ‘cookies. These cookies are used to store information including visitors’ preferences, and the pages on the website that the visitor accessed or visited. The information is used to optimize the users’ experience by customizing our web page content based on visitors’ browser type and/or other information. Under the law of some jurisdictions, such as California, you may be entitled to request disclosure of how Stateside Brands shares your usage information with third parties for marketing purposes. To the extent legally required, we will provide such information to you upon your written request to Stateside Brands. Be advised that we will not share your personal information with any third party unless you have expressly permitted that it be shared.
USER GENERATED CONTENT
The Sites may, from time to time, contain interactive areas where users may submit comments or other content (including information about the user that might be displayed in the user’s public profile within a social media community) that may be posted on the Sites or otherwise published. If you do this, be aware that when you disclose personally identifiable information in content submitted for posting or publication, the information can be read and used by others. We make no representations and undertake no obligations as to the security of information you voluntarily include when submitting content.
SECURITY
Stateside Brands uses reasonable and appropriate measures to safeguard any personal information that you provide to us. However, since no transmission or storage of electronic data is entirely secure, we cannot warrant or guarantee that your information will never be released in a manner that is inconsistent with this policy. By using the Sites, you agree to assume all risk in connection with the information sent to us or collected by us when you use the Sites. In the event that we believe that the security of your information in our possession or control may have been compromised, we may seek to notify you by email (if we are in possession of your email address).
THIRD PARTY SERVICES
We may share your data with third-party vendors, service providers, contractors, or agents (“third parties”) who perform services for us or on our behalf and require access to such information to do that work. We have contracts in place with our third parties, which are designed to help safeguard your personal information. This means that they cannot do anything with your personal information unless we have instructed them to do it. They will also not share your personal information with any organization apart from us. They are committed to protecting to holding data our behalf and to retain it for the period we instruct.
Our Sites may contain links to affiliate and other websites. Stateside Brands does not claim nor accept responsibility for any privacy policies, practices and/or procedures of other such websites. Our third parties have their own policies regarding the collection, use, and disclosure of personal information. All matters relating to the Sites are governed by the laws of the Commonwealth of Pennsylvania in the United States. If you are located outside the United States and you access our Sites, any information that you provide will be transferred to the United States. By submitting such information, you explicitly authorize the transfer and processing of your information within the United States. By using the Sites, you represent and warrant that, pursuant to the applicable laws where you are located, you are legally authorized to access and use the Sites.
PROTECTION OF CHILDREN AND USER AGE VERIFICATION
The Sites features, programs, promotions and other aspects requiring the submission of personally identifiable information are not intended for children, and we will not knowingly allow anyone under 13 to provide us with any personally identifying information. The Sites are not directed to nor intended for users who are younger than the age of 21. Stateside Brands does not knowingly collect personal information from any user under the age of 21. Under no circumstances may you use the Sites or submit personal information to Stateside Brands if you are under 21 years of age.
If you are under of the age of 21 years of age and have entered the Sites by providing a false date of birth, or having someone provide false information on your behalf, you must immediately leave the Sites as you are not authorized to use them.
CHANGES TO THE PRIVACY POLICY
We may update this Privacy Policy from time to time by taking one or more of the following steps: (1) note the date the Privacy Policy was last updated above, and (2) when a material change is made to the Privacy Policy, we may post announcements of such changes on the homepage of the Sites.
Your use of the Sites following the posting of any revised Privacy Policy shall be deemed acceptance of the revised policy. If we are required by law to obtain your express consent for any changes to the Privacy Policy, then we will make a commercially reasonable attempt to obtain your consent before implementing such revisions.
